Community Guidelines

1. 1. Introduction

   These guidelines govern the use of the community "CLUB TOKI" (hereinafter referred to as the "Community") operated by Toki Air Corporation (hereinafter referred to as the "Operator") and establish the rules among users and the relationship between the Operator and users. By registering for participation in the Community, users are deemed to have agreed to these guidelines, and a contract concerning the use of the Community, including the terms set forth herein, is established between the Operator and the user.

2. 2. Community Use

   The Community is using Discord as a communication platform. Anyone can join for free, but some limited channels can only be used by TOKI AIR NFT holders. Furthermore, all information provided by the Community and the benefits available to NFT holders will be communicated through Discord. Even if you are an NFT holder, you may not receive benefits if you do not participate in the Discord community, and we cannot compensate for not participating due to user convenience; please understand this in advance.

3. 3. Prohibited Activities

   Users of the Community are strictly prohibited from engaging in any offensive, discriminatory, defamatory, damaging to the Operator's image, or otherwise illegal or grossly inappropriate behavior towards other users and the Operator, regardless of whether such behavior occurs within or outside the Community. Impersonation, spam, advertising, and other posts that do not align with the purpose of the Community are also prohibited. For matters not mentioned in these guidelines, users are required to comply with and adhere to Discord's Community Guidelines.

4. 4. Operator's Rights and Responsibilities

   The Operator reserves the right to take measures such as warning violators, removing them from the Community, or deleting their accounts if prohibited or other guideline-violating activities occur within the Community. The Operator will strive to ensure that users can use the Community smoothly, but the Operator will not be involved in user disputes, except for those caused by the Operator's fault, and users will resolve such disputes among themselves. The Operator shall not be liable for any damages or compensation to users under any name or title.

5. 5. Changes to the Guidelines

   The Operator may revise these guidelines without notifying users. Changes to these guidelines will take effect when the revised guidelines are posted on the Community or the Operator's website. Users have a responsibility to regularly check for changes to these guidelines.

6. 6. Disclaimer

   The Operator makes no guarantees regarding the accuracy, completeness, timeliness, usefulness, or other aspects of the information provided in the Community. Users shall handle all actions and their results within the Community at their own expense and responsibility, and the Operator shall not be liable for any such actions or their results. The use of the Community may require the use of services provided by third-party platform (e.g., Discord, wallet for NFT storage). The Operator may introduce these services as reference information for users, but the Operator shall not be liable for any services provided by third-party platform. However, this shall not apply if the Operator has acted intentionally or with gross negligence.

7. 7. Intellectual Property Rights

   Copyrights, trademark rights, patent rights, and other intellectual property rights related to the information and content provided in the Community belong to the Operator or rightful rights holders. Users shall not engage in any activities that infringe on these intellectual property rights.

8. 8. Handling of Personal Information

   The handling of personal information in the Community shall be carried out appropriately in accordance with the privacy policy separately established by the Operator. Furthermore, all user account information belongs to Discord, the platform provider, and for the handling of personal information related to Discord accounts, please refer to the Discord Privacy Policy.

9. 9. Measures against Violations of the Guidelines

   The Operator may take appropriate measures, such as requesting a user to correct a violation of these guidelines or suspending the user's account, if the Operator determines that the user has violated these guidelines.

10. 10. Interpretation of the Guidelines

    The interpretation of these guidelines shall be governed by Japanese law, and any disputes concerning these guidelines shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location as the court of first instance.
